In a direct response to the recently passed age verification law in Virginia, Pornhub has taken a significant step by blocking users with Virginia-based IP addresses from accessing their platform. This move, which is aimed at complying with the new legislation, requires users to submit government identification to verify their age before being able to view adult content on the popular pornography site. With the law coming into effect on Saturday, Virginians will soon realize that accessing Pornhub has become a thing of the past.

Upon attempting to access the website, users from Virginia will encounter a message that opposes the legislation, accompanied by a video featuring renowned porn actress Cherie Deville. The statement emphasizes the requirements imposed by Virginia’s elected officials, who demand age verification before granting access to the platform. While safety and compliance are paramount to Pornhub’s mission, the site argues that repeatedly providing identification for every visit is not the most effective solution in protecting users. Additionally, the statement highlights the potential risks to children and user privacy associated with this verification process.

Moreover, Pornhub questions the efficacy of the law, suggesting that it fails to enforce age verification uniformly across platforms. This inconsistency allows some platforms to choose whether or not to comply with the requirement. Pornhub asserts that the best approach to safeguard children is to identify users based on their devices, granting access to age-restricted materials and websites accordingly. The site emphasizes the superior Trust and Safety measures they have in place compared to other platforms, underscoring the need for legislation that applies uniformly to all platforms offering adult content to ensure comprehensive child protection and user privacy.

 

Governor Youngkin’s Considerations:

 

Prior to signing the bill in May, Governor Glenn Youngkin expressed his concern regarding Pornhub’s potential response to the legislation. He acknowledged the importance of protecting children from exposure to pornography and assured that he would carefully evaluate the consequences of the bill before making a decision. Governor Youngkin’s primary objective is to create an environment that shields minors from explicit material. Consequently, the age verification law was designed to hold commercial entities accountable for publishing content deemed “harmful to minors” online.

 

Understanding the Age Verification Law:

 

According to the legislation, commercial entities publishing material considered “harmful to minors” on the internet must ensure that users accessing their websites are 18 years of age or older. To achieve age verification, users are required to submit copies of government-issued identification or employ other reasonable methods for verifying their age and identity. The bill defines material “harmful to minors” as content that includes descriptions or representations of nudity, sexual conduct, or sexual excitement, and caters to the prurient, shameful, or morbid interests of minors without significant literary, scientific, or artistic value.

It’s important to note that violating the law does not lead to criminal penalties. However, entities found in violation can be held liable for civil liabilities.

 

Pornhub’s Response: Second State to Face Restriction:

 

Virginia is the second state to experience access restrictions from Pornhub. Utah passed a similar age verification law in March, leading to the site blocking users from that state shortly before the law went into effect in May. This pattern indicates Pornhub’s willingness to comply with legal requirements that impact its platform. It remains to be seen how other states will address the issue of age verification and its consequences for the accessibility of adult content platforms.

 

Concerns Raised by Free Speech Advocates:

 

Advocates for free speech have raised concerns about the new legislation, specifically focusing on the potential vulnerability of personal data related to pornography usage. They argue that the requirement to provide identification increases the risk of data breaches and compromises user privacy. While protecting minors from explicit content is essential, it is crucial to address the potential consequences of this legislation to ensure a balance between safeguarding minors and preserving privacy rights.

As Pornhub blocks access for Virginia users in response to the new age verification law, disappointment is likely to be felt by individuals accustomed to accessing the platform.
