Italy Halts Antitrust Investigation Into Meta’s WhatsApp AI as European Union Assumes Control

The competition authority of Italy has officially closed its antitrust investigation into Meta Platforms regarding the integration of artificial intelligence tools into the WhatsApp messaging service. The decision, announced on Monday, comes as the European Commission expands its own review of the tech giant’s practices to explicitly include the Italian market. This change signifies a key point regarding the current review of the manner in which tech firms use automated programs. Ultimately, the millions of users that, on a daily basis, will have their relationship with third parties on mobile phones defined by this review will be affected by what the outcome of this dispute shall be.

Regulating Agency in Italy (AGCM) started investigating into US tech company in July 2025. From there, Agencies have raised concerns that the media business would abuse its dominant position in Social Media. The Inquiry focus was how Company introduced its proprietary AI Assistant, within WhatsApp. Regulating Agencies expressed concerns that this could limit competition and consumer options, in fast moving digital world.

The Core Allegations Against Meta

The new terms for the WhatsApp Business Solution introduced by Meta were the primary object of the inquiry. As stated by the Italian regulator, these terms were written in a way that would ensure that the Artificial Intelligence Solution developed by the company would be given prime placement on the messaging platform as opposed to allowing other developers of chatbot services to have access to the vast user base of the messaging platform. The authorities held that the company was limiting the ability for other companies to develop technology and gain access to the marketplace due to the exclusionary practices of the Whatsapp Business Solution. It was believed that these practices will ultimately be detrimental to the consumer as consumers need to have the ability to choose from many different types of digital services.

Interim Measures and Regulatory Actions

Prior to discontinuing the case, Italy’s anti-competitive sector regulator (the Autorita Garante della Concorrenza e del Mercato, or AGCM) took action to limit what they determined to be anti-competitive activity. This was evidenced by the fact that they issued a temporary regulation requiring Meta to cease enforcing its prohibitive terms against competitive artificial intelligence applications on WhatsApp in late December 2025. The rationale for this temporary regulation was the imminent danger of irreparable damage to competition if the prohibitive terms were fully implemented. This temporary regulation indicates that the AGCM is dealing with this situation urgently.

The European Commission Takes the Reins

The end of the national investigation does not mean that Meta’s business practices are correct; instead it has resulted in a greater concentration of regulatory oversight. The AGCM stated that the only reason it suspended its investigation in Italy is that the Commission enlarged the scope of its overarching investigation (into Meta’s activities) to cover Italy. In this way, the Italian authority avoids duplicate proceedings and jurisdictional issues in connection with Meta’s actions. The European Union’s executive will lead the broader investigation into whether Meta’s methods of integration violate the very strict rules governing digital markets in the European Union.

Implications for the Tech Industry

Brussels has formally assumed the responsibility of investigations into technology companies such as Meta Platforms (formerly Facebook Inc.). As the European Union’s central enforcement power continues to expand, now, it has become apparent that Meta will likely be much more impacted than they imagined or initially prepared to be. Europe and Meta’s financial penalties can be extremely damaging — and, in some cases, provide a type of operational mandate for how they will operate in the future. Additionally, this case represents an important benchmark for tech companies going forward. As the largest technology players integrate AI into consumer products, they will be monitored on a global basis to prevent dominant platforms using their large user base to eliminate up and coming competition.
