Bollywood actor Preity Zinta emerged victorious against a ₹10 crore tax demand after the Income Tax Appellate Tribunal (ITAT) Mumbai ruled in her favor, citing critical flaws in the tax reassessment process. Zinta’s tax woes began with a reassessment of her 2016 income tax return where she had filed as a non-resident, declaring an income of Rs 46 lakh. The tax authorities noticed large credit and debit transactions amounting to Rs 13.10 crore in a newly opened bank account in 2016, far exceeding her declared income, sparking suspicion of undisclosed income.​

Major Reassessment Flaw Cited by ITAT:

The income tax officer invoked Section 147 to reopen Zinta’s case, and a draft assessment order proposed to push her total reported income to Rs 11.3 crore, adding Rs 10 crore as unexplained cash credit under Section 68. Despite Preity’s objections before the Dispute Resolution Panel (DRP), the additions were upheld, and a final order against her was issued in January 2023. However, Preity appealed against this decision before the ITAT Mumbai, which examined procedural and jurisdictional lapses in the reassessment. The tribunal found the reopening was not properly justified and ruled that the tax department and DRP failed to correctly assess the reassessment’s validity. Consequently, ITAT set aside the demand, overruling earlier orders and instructing a review of the reassessment process.​

Bank Transactions and Tax Department’s Concerns:

During the investigation, tax authorities concentrated on the credit and debit of around Rs 13 crore in a Corporation Bank savings account that was opened in January 2016. The entire credit and debit cycle took place in a short period of time, and the account balance was reduced to just Rs 10,300 as a result of these big transactions. The tax department questioned the authenticity of the source of such funds, classifying the majority of the credited amount as an unexplained cash credit and asserting a tax due on that basis. However, the ITAT noted that Zinta had satisfactorily provided explanations and appropriate papers proving the nature and source of the transactions, which the authorities had previously disregarded. This misinterpretation led to the flawed reassessment and the subsequent withdrawal of the hefty tax charge.​

Preity Zinta’s Legal Strategy and Representation:

Preity was represented by Advocates Dharan Gandhi and Vinita Nara, who successfully challenged the income tax department’s reassessment on grounds of flawed procedure and insufficient justification. The legal team argued that the reopening notice violated Section 147 conditions, and ITAT agreed, emphasizing that reassessments must be based on tangible evidence rather than mere suspicion. This verdict not only absolves Zinta of the ₹10 crore demand but also sets a precedent that tax authorities cannot arbitrarily reopen assessments without strict procedural compliance. Zinta’s victory underscores the importance of due process in tax disputes and offers reassurance to taxpayers facing similar reassessments under questionable premises.​

The case draws attention to complex issues faced by non-resident taxpayers in India regarding unexplained bank transactions, especially when the transactions relate to income streams outside India or involve third-party payments. Zinta’s successful navigation through the legal maze also highlights the role of tribunals in safeguarding taxpayers’ rights against arbitrary or flawed tax enforcement actions.​ Overall, this outcome is a significant relief for Preity Zinta and exemplifies a win against aggressive tax reassessment practices, reinforcing fair treatment and transparency in taxation.
