The Savannah Police Department has fired six employees following an internal investigation into the alleged misuse of the department’s Flock Safety automated license plate reader system. The disciplinary action comes as the Georgia Bureau of Investigation conducts an independent criminal investigation into unauthorized searches of the surveillance database.
The case has raised questions about how law-enforcement agencies use automated license plate recognition technology and what safeguards are in place to prevent officers and other authorized users from accessing information for improper reasons.
The Savannah Police Department launched its internal review after concerns emerged about searches conducted through the Flock Safety system. The technology allows police agencies to locate and track vehicles that have been captured by a network of automated cameras. The cameras record information such as license plate numbers, vehicle characteristics and the time and location at which a vehicle was detected.
Investigators reviewing the Savannah department’s system activity examined approximately 39,000 searches. The review identified 127 searches that officials determined were inappropriate or did not appear to have a legitimate law-enforcement purpose.
As a result of the investigation, six employees were terminated. The group included four police officers and two civilian employees, according to information released during the department’s review.
The terminations represent the department’s administrative response to the alleged misuse. However, the findings do not necessarily establish that those involved committed criminal offenses. That determination will be left to the Georgia Bureau of Investigation, which is conducting a separate investigation at the request of local officials.
The GBI’s involvement adds another level of scrutiny to the case. Investigators will examine whether any of the unauthorized searches violated state law or other criminal statutes. The investigation could ultimately result in criminal charges, although no such charges have been announced.
The distinction between the police department’s internal investigation and the GBI investigation is significant. Police departments can discipline employees for violating departmental policies even when conduct does not rise to the level of a criminal offense. The GBI, meanwhile, is tasked with determining whether evidence supports possible criminal violations.
