Best Personal Loan: Questions to Ask Before Signing the Loan Agreement

Finding the best personal loan is not just about getting the lowest interest rate or the highest sanctioned amount. Before signing, check what you will actually pay, when the EMI is due, what happens if you miss a payment and whether you can close the loan early. The loan agreement and Key Facts Statement (KFS) should answer these questions clearly. For digital loans, RBI requires the KFS to be provided before the borrower executes the loan contract.

1. Who is the Actual Lender?

If you are applying through a personal loan app, first identify the bank or NBFC that is actually providing the loan. The app may facilitate the application, but the regulated entity is responsible for the lending arrangement. Check the lender’s name in the sanction letter, KFS and loan agreement. 

Also avoid accepting loan offers through unknown SMS, WhatsApp or social media links. Verify the digital lending platform and lender through official sources before sharing PAN, Aadhaar, bank details or other personal information.

2. What Is the Actual Cost of the Loan?

Don’t judge a loan only by its advertised interest rate. Ask: “How much will I repay in total by the end of the tenure?”

Check these figures before signing:

  • Interest rate
  • Annual Percentage Rate (APR)
  • Processing fee and applicable taxes
  • Documentation or other applicable charges
  • EMI amount
  • Total repayment amount
  • Penal or late-payment charges

For applicable digital loans, the APR represents the all-inclusive annual cost of credit, and key charges are required to be disclosed through the KFS.

A loan with a slightly higher advertised rate can sometimes have a different overall cost depending on fees and tenure, so compare the complete offer.

3. How Much Will the EMI Be?

The EMI should fit comfortably within your monthly budget, not merely within the lender’s eligibility criteria.

Before accepting the best personal loan offer, calculate your:

Monthly income – essential expenses – existing EMIs – regular financial commitments = available monthly surplus

Then see whether the new EMI leaves you with enough room for savings and unexpected expenses. Don’t choose a longer tenure automatically because it gives you a smaller EMI. It can increase the total interest paid over the loan period.

4. What Happens If You Miss an EMI?

Don’t wait until after signing to find out. Check the agreement for:

  • Late-payment or penal charges
  • How overdue amounts are calculated
  • Impact on your credit history
  • Any additional collection or recovery-related provisions
  • The process for raising a repayment-related complaint

Your EMI due date should also fit your salary or regular income cycle where possible. Setting up reminders or an appropriate repayment mandate can help avoid accidental missed payments.

5. Can You Prepay or Foreclose the Loan?

If you expect to have extra money later, ask whether the lender allows part-prepayment or foreclosure and whether any charges apply. Also check whether there are minimum amounts or conditions attached to partial repayment.

For floating-rate EMI-based personal loans, RBI has specific requirements around communicating interest-rate resets and the options available to borrowers when rates change. Don’t assume that early repayment will always reduce your cost by a particular amount. Check the actual terms in your agreement.

6. What Documents Will You Receive?

Before signing, make sure you have access to the complete documentation—not just a summary displayed in the app. Your documents should allow you to verify:

  • Sanctioned loan amount
  • Interest rate and APR
  • EMI and repayment schedule
  • Processing fee and other charges
  • Tenure
  • Prepayment conditions
  • Penal charges
  • Grievance redressal details

RBI’s fair-practices framework requires lenders to provide borrowers with a copy of the loan agreement and its enclosures.

Save these documents somewhere accessible so you can refer to them later.

7. What Data Will the Personal Loan App Access?

Digital convenience should not mean giving an app unrestricted access to your phone. For regulated digital lending, the RBI’s framework requires data collection to be need-based and based on prior, explicit borrower consent. Digital lending apps and lending service providers also have requirements around privacy policies and handling borrowers’ personal information.

Before granting permissions, understand why the information is being requested and check the app’s privacy policy.

8. How Will You Raise a Complaint?

A genuine lender should have a clearly defined grievance redressal mechanism. Before signing, know:

  • Where you can submit a complaint
  • Who handles loan-related grievances
  • How to contact the lender’s grievance officer
  • What escalation options are available if your complaint is not resolved

For digital lending, RBI requires regulated entities to have grievance redressal arrangements, with relevant contact details made available to borrowers.

Conclusion

Before accepting a loan agreement, make sure you can answer yes to these questions. The best personal loan is not necessarily the one with the lowest advertised rate or fastest approval. It is the one whose total cost, repayment terms and EMI work for your financial situation. Taking these few minutes to check the agreement can help you avoid unpleasant surprises after the loan is disbursed.
