In a dramatic escalation of the legal clash between Elon Musk’s ventures and the Brazilian judiciary, a Supreme Court judge in Brazil has ordered the freezing of Starlink’s bank accounts. This decision intensifies an ongoing dispute involving X, the social media platform formerly known as Twitter, and reflects broader tensions between Musk’s companies and Brazilian law.

On Thursday, Brazil’s Supreme Court ordered Starlink, Musk’s satellite internet service, to halt all financial transactions within the country. This move is a notable escalation in the protracted legal battle between Musk’s enterprises and Brazilian authorities. The core of the conflict has been centered on Supreme Court Justice Alexandre de Moraes’ demands for X to block certain accounts in Brazil, which X has denounced as violations of free speech.

Earlier this month, X ceased operations in Brazil, protesting court orders it labeled as “censorship.” The company argued that these orders infringe on free speech and conflict with Brazilian law.

New Target: Starlink

In a surprising twist, Justice de Moraes has now turned his attention to Starlink, potentially using it as leverage against X. Starlink has criticized the court’s decision, claiming it unjustly holds the company responsible for fines against X, which Starlink argues were imposed without proper legal procedures.

The company issued a statement condemning the “secret” nature of the court order and the lack of due process. “This order is based on an unfounded determination that Starlink should be responsible for the fines levied—unconstitutionally—against X,” Starlink said. “We intend to address the matter legally.”

X’s Legal Threats

Justice de Moraes has further threatened to shut down X in Brazil if the platform fails to comply with his demands. On Wednesday, de Moraes gave X until Thursday evening to appoint a legal representative in Brazil, warning that failure to comply would lead to a suspension of its operations.

X responded by reaffirming its commitment to free speech and critiquing the judge’s demands. “We are absolutely not insisting that other countries have the same free speech laws as the United States,” X stated. “The fundamental issue is that Judge de Moraes demands we break Brazil’s own laws. We simply won’t do that.”

The company plans to release details of the judge’s “illegal demands” and related court documents soon, signaling its intent to challenge the orders extensively.

Legal and Constitutional Issues

Starlink’s response underscores its concern over the legal process involved. The company argues that the court’s actions lack transparency and violate Brazil’s constitutional guarantees of due process. Starlink contends that the judge’s orders are based on a flawed assumption that it should bear responsibility for X’s fines, which Starlink believes are unconstitutional.

Starlink has indicated its intention to challenge the ruling through legal channels, emphasizing its right to fair treatment under Brazilian law.

The escalating legal dispute in Brazil highlights significant issues for global technology companies operating under diverse national regulations. The confrontation between Musk’s ventures and Brazilian authorities raises questions about the balance between national laws and global corporate policies, particularly in the realm of internet regulation and free speech.
