The latest Visa Bulletin from the US State Department has raised alarms among applicants and businesses relying on employment-based immigrant visas, warning that several key categories may become unavailable before the fiscal year ends in September 2025. This comes as Indian and Chinese nationals continue to face historic wait times and backlogs, but the problem now affects applicants globally as rapidly rising demand threatens to exhaust annual visa quotas.

For many Indian professionals, the unavailability of employment-based green card categories could halt their US residency dreams until the new fiscal year begins in October. According to the US State Department, preference classes like EB-1, EB-2, EB-3, and EB-5 are at risk of reaching their maximum fiscal year limits as early as August or September. If this happens, these classifications will be marked “unavailable,” effectively closing the door on new immigrant visas within those categories until the allocation resets October 1.

This situation has been attributed to overwhelming demand for employment-based immigrant visas, with the US government noting consistent increases throughout FY-2025. Indian applicants, often the largest pool within EB categories, are especially affected due to strict per-country limits and the high volume of applications.

Growing Demand and Visa Bulletin Updates:

The September 2025 Visa Bulletin has revealed that family-sponsored F2A Green Card applications remain open for Indian residents, allowing spouse and minor child filings to continue. However, employment-based Green Card categories are either stalled or at imminent risk of closure. Final Action Dates for India remain unchanged: February 15, 2022, for EB-1; January 1, 2013, for EB-2; May 22, 2013, for EB-3 (Professionals/Skilled Workers); with EB-4 still marked as unavailable and EB-5 (Unreserved) at November 15, 2019.

Experts point out that demand for these visas has surged due to shifts in US labor markets and expanding opportunities for international talent. Tech firms, medical institutions, and research organizations continue to sponsor thousands of skilled workers, making employment-based categories oversubscribed well before the fiscal year ends.

A unique development in 2025 is that, while the EB-2 and EB-3 categories are expected to “freeze” for India and China, EB-5 set-aside categories including rural, high unemployment, and infrastructure remain current, offering potential for those who can invest through specialized programs. However, warnings persist that even reserved EB programs may face backlogs due to heightened global interest.

What Visa Applicants Should Know:

Applicants should closely monitor the monthly Visa Bulletin and take immediate action if their category is still listed as open for filings in light of the expected freeze. While “Filing Dates” specify when an application can be submitted for review and status modification, “Final Action Date” establishes when an application can be authorized for permanent residency.

After the quota is met, further applications in the affected categories will not be accepted until the yearly allotment resets on October 1, 2025, the beginning of the following fiscal year. Potential deficiencies in EB-2, EB-3, and EB-5 unreserved categories have already been brought to the attention of the Department of State.

During this freeze, no additional immigrant visa numbers will be issued for oversubscribed categories, and applicants may face longer delays before their case advances for processing. Meanwhile, family-sponsored categories such as F2A remain open, and adjustment of status for eligible spouses and minors should proceed as normal.

Applicants are advised to seek legal counsel about alternative immigration pathways, monitor the bulletin for actionable dates, and prepare documentation in advance for swift filing should the category reopen.

Outlook for Indian and Global Applicants:

For India and other high-demand countries, the looming unavailability further complicates the already lengthy Green Card process. Strict numerical limits and high demand ensure that, even when allocations reset, queues will likely remain long and processing times slow.

In response, some experts advocate for reform of per-country caps and expansion of reserved visa categories to alleviate bottlenecks for skilled workers and investors. Until then, the US immigration landscape remains a challenging field for employment-based applicants, marked by unpredictability and a need for timely response.

As the end of the fiscal year approaches, individuals and employers must remain vigilant and flexible. While applicants for family-sponsored visas may continue filing, those seeking employment-based Green Cards will need to adapt to shifting availability and prepare for potential delays until the next cycle begins.
