India’s finance ministry has issued an internal advisory instructing its employees to avoid using AI tools, including ChatGPT and DeepSeek, for official purposes. The ministry has cited concerns regarding the confidentiality of government documents and sensitive data as the primary reason for the restriction.

The advisory, dated January 29, 2025, highlights the risks associated with AI-powered applications when handling government information on official computers and devices. While the directive applies specifically to the finance ministry, it remains unclear whether similar instructions have been issued to other Indian ministries and government departments.

The move comes at a time when governments across the world are re-evaluating the security risks associated with AI models, particularly those developed by foreign entities.

Security Risks and Global AI Restrictions

India is not the first country to impose restrictions on AI tools in government offices. Countries such as Australia and Italy have also banned or restricted the use of DeepSeek, citing similar concerns regarding data security and confidentiality.

Large language models (LLMs) like ChatGPT and DeepSeek process user inputs through remote servers, raising concerns about data transmission, storage, and potential breaches. Government agencies are particularly wary of unintentional data leaks, which could expose sensitive policy discussions, financial strategies, and classified information.

Finance Ministry’s Advisory on AI Tools

The advisory explicitly warns employees about the dangers of entering sensitive government data into AI platforms, emphasizing that:

AI tools process and store user inputs, making it possible for third parties to access or exploit confidential information. AI-generated responses are not always accurate and may lead to misinformation in government decision-making. Using AI tools without strict data governance policies can create compliance risks under India’s IT and data protection laws.

The directive urges ministry employees to exercise caution and rely on officially sanctioned communication channels and data processing systems instead of external AI-powered platforms.

OpenAI’s India Challenge: Copyright Battle and Regulatory Scrutiny

The finance ministry’s directive arrives amid mounting legal challenges for OpenAI in India. The company is currently embroiled in a copyright infringement lawsuit filed by some of India’s largest media organizations.

OpenAI has maintained in court that:

It does not operate servers within India, meaning Indian courts should not have jurisdiction over the case. The company’s AI models do not intentionally scrape copyrighted content, though concerns persist about its data training processes.

Additionally, regulatory bodies in India have been closely examining AI’s impact on data privacy, media rights, and cybersecurity. The finance ministry’s latest advisory could signal a broader government crackdown on unrestricted AI usage in official domains.

Interestingly, reports about the AI ban surfaced on social media just ahead of OpenAI CEO Sam Altman’s visit to India, scheduled for Wednesday. Altman is expected to meet with India’s IT minister and key government officials to discuss AI regulation, industry collaboration, and OpenAI’s role in India’s growing AI ecosystem.

However, the timing of the finance ministry’s directive may suggest a tougher stance on AI governance in India. While the government is actively promoting AI innovation through initiatives like the IndiaAI Mission, it is also keen on ensuring strict data protection measures and limiting the risks of AI-generated misinformation.

India is emerging as a global AI powerhouse, with startups, enterprises, and government agencies increasingly adopting AI for healthcare, finance, education, and governance. However, concerns over privacy, security, and bias continue to shape policy decisions.

Experts argue that:

AI regulation is necessary to prevent misuse and safeguard national security interests. A blanket ban on AI tools may hinder productivity and innovation, especially in areas like data analytics, policymaking, and research. The government should focus on creating AI guidelines that ensure responsible and ethical use rather than outright prohibitions.

The finance ministry’s move could have wider implications for AI adoption in government agencies. If other ministries follow suit, AI models like ChatGPT, DeepSeek, and Gemini could face more stringent restrictions in India.

However, it is also likely that the government will develop sector-specific AI regulations, rather than impose a complete ban. Future policies may require:

Stronger AI data governance frameworks for public sector institutions. On-premise AI models that do not rely on external servers. Collaborations with Indian AI startups to build secure, localized alternatives.

India’s finance ministry’s decision to prohibit AI tools like ChatGPT and DeepSeek for official use underscores growing concerns about data security and AI governance. As global AI adoption accelerates, governments must find a balance between leveraging AI’s benefits and addressing potential risks.

While OpenAI and DeepSeek remain valuable AI resources, their future in India’s government operations will largely depend on how well AI regulations evolve to ensure both innovation and data protection. As India navigates this complex AI landscape, the world will be watching closely to see how one of the fastest-growing tech economies approaches AI regulation and security.
