Karnataka to Introduce New Law Banning Online Gambling, Allowing Skill-Based Games

Karnataka is preparing to create a new regulatory framework that would prohibit online gambling while allowing skill-based games to operate within the state. This action is comparable to one taken by Chhattisgarh, which has been effective since March 2023. The ruling comes as India’s gaming industry expands fast, highlighting the need for clear laws.

Background and Motivation Behind the Ban:

In recent years, Karnataka has faced challenges in regulating online gaming due to the lack of clear legislation. In 2021, the state passed a bill banning all forms of online gambling, including skill-based games. However, in 2022, the Karnataka High Court struck down most of the law, calling it unconstitutional. The state appealed to the Supreme Court, and the case remains pending. The new approach aims to address past legal issues and support the industry without compromising consumer safety.

Karnataka IT-BT Minister Priyank Kharge emphasized that the government does not intend to harm the gaming industry but rather create a supportive environment. “We are working to ensure that, with their help, we can create a framework that fosters innovation, sustains the industry, and builds skills while also protecting people from losing money to fraudulent gaming sites or shady networks operating outside the system,” Kharge stated.

Learning from Chhattisgarh’s Model:

Chhattisgarh introduced its online gambling law in March 2023, banning games of chance while allowing skill-based games to operate legally. Karnataka is now considering adopting a similar structure, with ongoing discussions involving the Law and Home departments to carefully define the difference between games of chance and games of skill.

Chhattisgarh’s rule only applies to games where the outcome is primarily influenced by chance, leaving out skill-based games where knowledge, expertise, and training influence the outcome. This method has been successful in differentiating between the two sorts of games and creating a structured environment in which the gaming business may thrive.

Impact on the Gaming Industry and Consumers:

The decision to ban online gambling while allowing skill-based games is expected to have a significant impact on both the gaming industry and consumers. For the industry, this move provides clarity and stability, allowing companies to operate within a well-defined legal framework. Skill-based gaming startups, which have been advocating for regulation rather than criminalization, are likely to benefit from this approach.

However, concerns remain about the effectiveness of banning online gambling, as many gamblers may turn to banned applications or unregistered platforms to evade detection. The rise of APK files and Telegram groups advertising such apps poses a challenge for law enforcement agencies.

Despite these challenges, Karnataka’s new law aims to strike a balance between supporting innovation and protecting consumers. By focusing on skill-based games, the state hopes to foster a sustainable gaming ecosystem that promotes skill development and entrepreneurship while minimizing the risks associated with games of chance.
