OpenAI-Apple Lawsuit: Former Employee Allegedly Sent 100 Confidential Files to Personal Account

A new filing in the ongoing legal dispute between OpenAI and Apple alleges that a former OpenAI employee sent around 100 files related to an unreleased product to a personal account before leaving the artificial intelligence company. The filing further claims that the former employee later presented information about the product to a senior Apple executive, raising concerns over the potential use of confidential information in Apple’s product development.

The allegations, presented in a court filing in San Jose, California, and reported by Reuters, claim that the presentation took place several months ago. OpenAI has also alleged that Apple is developing products based on the insights shared during the presentation, pointing to the launch of Apple’s Home View product this week.

In the filing, OpenAI expressed concern that its trade secrets and confidential information could now be accessible to Apple employees working on upcoming products.

Apple, however, has rejected the allegations, stating that it maintains policies and procedures to ensure new employees do not use confidential information belonging to their previous employers. The company also said it had no evidence supporting OpenAI’s claims.

The latest filing adds another dimension to an already contentious legal battle between the two technology companies, with both sides facing allegations involving the handling of sensitive product information.

Apple vs OpenAI: How the Legal Dispute Began

The latest allegations come amid a trade secret lawsuit initially filed by Apple earlier this year. The iPhone maker alleged that employees who left the company to join OpenAI’s hardware division took confidential information, including product designs and other proprietary material.

OpenAI has denied Apple’s allegations. The latest filing, in which OpenAI raises concerns about a former employee allegedly sharing its own confidential information with Apple, effectively introduces competing claims over the handling of trade secrets.

Apple’s original lawsuit alleged that OpenAI had recruited former Apple employees who subsequently provided confidential company information. Among the individuals named in the dispute is Tang Tan, OpenAI’s chief hardware officer and a former Apple vice president.

Apple has also named former employee Chang Liu in its filings. The company alleged that Liu took an Apple laptop when he left and exploited an authentication vulnerability to access its internal network. According to Apple’s claims, he downloaded dozens of confidential files related to Apple’s hardware development.

These allegations remain part of the ongoing legal dispute and should not be treated as established findings of wrongdoing.

OpenAI Raises Concerns Over Apple’s Product Development

OpenAI’s latest filing focuses on the alleged transfer of approximately 100 files concerning an unreleased product to a personal account. The company claims the former employee subsequently discussed the product with a senior Apple executive.

OpenAI has argued that the alleged disclosure could create a risk of its proprietary information influencing Apple’s future hardware and software development. Its concerns centre on whether confidential product insights could be used by engineers working on competing offerings.

The filing also references Apple’s recently introduced Home View product as part of OpenAI’s argument. However, the allegations alone do not establish that the product was developed using OpenAI’s confidential information.

Apple’s response underscores the central disagreement between the companies. The company maintains that it has safeguards intended to prevent employees from bringing confidential information from previous workplaces into its operations and says it has seen no evidence supporting OpenAI’s claims.

The dispute could therefore hinge on evidence concerning the alleged file transfers, the contents of the presentation and whether any protected information was subsequently used in product development.

From Partnership to Legal Battle

The lawsuit marks a sharp deterioration in the relationship between the two companies, which announced a major partnership in 2024. Under the arrangement, Apple integrated ChatGPT into its ecosystem, allowing users to access OpenAI’s chatbot through supported features across iPhones, iPads and Macs.

The partnership positioned OpenAI as an important part of Apple’s artificial intelligence strategy. However, Apple’s subsequent move towards Google’s Gemini to power its next-generation Siri ambitions highlighted the increasingly competitive nature of the AI market.

Both companies are now expanding their efforts in artificial intelligence and hardware, making intellectual property and employee mobility important areas of contention.

For technology companies, employees moving between competing businesses can create difficult questions about the distinction between professional experience and protected trade secrets. Companies generally remain free to hire experienced workers, but confidential information belonging to a former employer may be subject to legal protections.
