The courtroom battle between Elon Musk and OpenAI has taken another dramatic turn, with explosive testimony shedding light on the growing tensions that shaped the modern AI industry.

What began as a legal dispute over OpenAI’s transformation from a nonprofit research lab into a commercial AI powerhouse has now evolved into a deeply personal clash involving accusations, internal disagreements, and even a golden “jackass” trophy.

At the center of the latest courtroom drama is Joshua Achiam, OpenAI’s chief futurist, whose testimony offered jurors a rare glimpse into the intense debates surrounding artificial intelligence safety and control.

A Heated Exchange Over the Future of AI

During his testimony, Achiam recalled a tense 2018 meeting with Musk, who was still closely associated with OpenAI before eventually leaving the company and later launching rival AI venture xAI.

According to Achiam, Musk expressed concerns that advanced artificial intelligence could be dangerously misused if developed irresponsibly. The futurist testified that Musk believed he needed to build his own AI company to ensure the technology would remain under safer control.

However, Achiam strongly disagreed with Musk’s proposed direction.

He told the court that he considered Musk’s approach to AI development “unsafe and reckless,” leading to an intense confrontation between the two men.

“We had a pretty tense exchange,” Achiam reportedly said during testimony. “He snapped and called me a jackass.”

The revelation immediately became one of the most talked-about moments of the trial, highlighting the personal friction between Musk and senior OpenAI leadership long before the current lawsuit began.

The Golden ‘Jackass’ Trophy That Stunned the Courtroom

In an unusual courtroom moment, OpenAI’s legal team reportedly presented a small golden “jackass” trophy tied to the confrontation.

Achiam testified that the trophy had been gifted to him by former OpenAI colleagues Dario Amodei and David Luan after the Musk encounter.

The gift, according to Achiam, was intended as a humorous show of support for standing up to Musk during the heated debate over AI safety.

The courtroom reportedly reacted with surprise and amusement as lawyers introduced the trophy. However, Judge Yvonne Gonzalez Rogers ultimately declined to admit it as formal evidence in the case.

Even so, the episode added another layer of intrigue to a trial already packed with dramatic revelations.

Musk’s Core Allegation Against OpenAI

Musk’s lawsuit centers on the argument that OpenAI abandoned the nonprofit mission upon which it was founded.

He has accused the company of prioritizing commercial growth and investor interests over its original commitment to developing AI for the benefit of humanity.

According to Musk, OpenAI’s increasingly close relationship with Microsoft fundamentally changed the organization’s structure and purpose.

The billionaire argues that the startup shifted away from openness and public-interest research after receiving billions in outside funding and integrating its technology into commercial products.

The case has become one of the most closely watched legal battles in Silicon Valley because it touches on larger questions surrounding who controls powerful AI systems and whether profit motives can coexist with AI safety.

OpenAI Pushes Back Against Profit-Driven Claims

OpenAI, however, strongly rejected Musk’s accusations during the proceedings.

The company argued that its partnership with Microsoft strengthened its ability to pursue advanced AI research while still supporting its broader mission.

John Coates, an expert witness for OpenAI, defended the Microsoft alliance in court and stated that the partnership had actually generated significant value for the nonprofit side of the organization.

“The partnership has generated value for the nonprofit,” Coates reportedly testified.

Jurors were also shown a 2018 email from Microsoft Chief Technology Officer Kevin Scott, who appeared to raise early concerns about OpenAI’s transition toward a for-profit structure.

In the email, Scott reportedly questioned whether OpenAI’s original donors fully understood how their contributions might eventually support a commercial AI business.

That email has now become a key piece of evidence in the trial, offering insight into how even close partners were privately discussing OpenAI’s evolving ambitions years ago.
