An Arizona federal jury ordered Uber Technologies Inc. to pay $8.5 million to a woman sexually assaulted by one of the company’s drivers, in a verdict seen as a major legal victory that could influence the outcome of thousands more cases pending against the ride-sharing giant.

Jaylynn Dean filed the lawsuit after she said she was raped by an Uber driver while taking a ride to her hotel in 2023. Following two days of deliberation, the jury found Uber responsible for the driver’s actions under the apparent agency doctrine that holds companies liable for the conduct of workers acting on their behalf.

The ruling marks a significant turn of events in the cases filed by Uber passengers claiming to have been assaulted by the firm’s drivers. Dean’s case was one of 20 “bellwether” cases chosen to be tried by a jury; these cases are expected to set precedence for around 2,500 other federal suits making similar allegations against the company.

Jury Awards $8.5 Million in Uber Sexual Assault Lawsuit, Punitive Damages Denied

At trial, Dean’s lawyers contended that Uber knew of thousands of sexual assaults by drivers but did little to make the service safer. The company had pitched itself as a safe way for women to travel around at night, lawyer Alexandra Walsh said in court.

“Women know it’s a dangerous world. We know about the risk of sexual assault,” Walsh said in court. “They made us believe that this was a place that was safe from that.”

That means the $8.5 million award compensates Dean, while the jury didn’t grant her bid to recover more than $144 million in punitive damages, intended as punishment against companies that behave badly. The jury also eliminated additional complaints that Uber had been negligent or that its safety systems were defective.

In its wake, lead attorney Sarah London said the decision “validates the thousands of survivors who have come forward at great personal risk.” She added that whether justice will be truly served depends on whether meaningful safety reforms protecting passengers will be created through such voluminous litigation.

Uber intends to appeal the judgment. The company, in its defence, believes it should not be held liable for criminal activities perpetrated by those using its platform. It cited that the drivers are independent contractors and not employees of the company. The driver in the assault case had a good rating by passengers and had no record of any crime; his act was therefore not predictable, Uber attorneys argued.

A Legal Tug-of-War Over Safety and Liability

An Uber spokesman keyed on the parts of the verdict that favoured the company, including that jurors “rejected the plaintiff’s claims of negligence and defective safety systems.” They also drew attention to the fact that the damages awarded were “far below what was sought,” and no punitive damages were given.

“This verdict affirms that Uber acted responsibly and has invested meaningfully in rider safety,” the spokesperson said, adding that in a previous bellwether case involving allegations of groping and unwanted kissing, the company was not found liable.

The apparent agency doctrine ruling is especially important because it confirms that Uber might be liable for driver actions on rides because the company designates its drivers as independent contractors. The doctrine may impact how judges and juries address thousands of other pending similar complaints.

The Battle of Uber Over Passenger Safety and Corporate Liability

In the past few years, the ride-sharing industry has taken increasing heat for how safe passengers are during rides. Several reports have documented cases of sexual assault and other violent acts by drivers. Such critics believe that Uber and Lyft should do more to implement increased safety and driver-screening policies.

Uber conducts background checks on its drivers as a normal practice for pre-screening, but advocates say these measures are very inadequate. The result of the remaining bellwether trials will likely determine whether Uber makes significant changes to its safety measures and how it handles assault allegations.

Now, with proceedings in court, the case is another reminder of the entangling questions of the gig economy, the classification of employees, and corporate responsibility in the actions of independent contractors operating under a company’s mark.

To Dean and other survivors taking legal action, the verdict represented a step toward accountability, though how much it ultimately mattered would depend on the many cases still to come.
