The recent decision to grant Elon Musk’s Department of Government Efficiency (DoGE) access to sensitive Treasury Department databases has sparked significant controversy. Critics are particularly worried about the potential exposure of human intelligence assets working abroad, which could have severe consequences for national security.
On January 31, Treasury Secretary Scott Bessent approved “read-only” access to Treasury’s payment systems for two DoGE employees, Tom Krause and Marko Elez. However, Elez, a 25-year-old employee, resigned amid allegations of posting racist tweets. Despite the scandal, Musk announced that he would rehire Elez, further fueling the debate over DoGE’s role.
Potential Dangers to Intelligence Operations
A senior Treasury official raised alarms in a memo to Secretary Bessent, warning that allowing DoGE access to the department’s payment system could compromise classified intelligence operations. The memo specifically highlighted the risk to payments made to human intelligence sources by agencies like the CIA and Defense Intelligence Agency (DIA). These payments are often deliberately concealed to protect the identities of foreign agents and assets.
Experts fear that with the right technical skills, individuals could easily detect these payments, revealing the identities of sensitive intelligence operatives, potentially putting their lives at risk. As a result, the memo urged the immediate suspension of DoGE’s access and called for a full review of any actions taken by its staff within the Treasury system.
Legal Action and Federal Injunction
On Saturday, a Manhattan federal judge issued a preliminary injunction, blocking DoGE from accessing Treasury Department databases containing personally identifiable information. The ruling also mandates that DoGE return any data it has already obtained. A hearing to discuss the future of the case is scheduled for February 14.
This legal action is part of a growing pushback against DoGE’s increasing influence. Originally created under the Trump administration, the department was tasked with identifying wasteful government spending. While some support Musk’s initiative to streamline government operations, others argue that the increasing power of DoGE under his leadership poses serious risks, especially concerning data security.
Attorney General’s Lawsuit Against DoGE
New York Attorney General Letitia James has filed a lawsuit challenging DoGE’s access to Treasury data, citing potential national security threats and misuse of the information. James has accused Musk’s group of attempting to halt essential federal payments, such as those for healthcare and childcare, which millions of Americans rely on.
“This unelected group, led by the world’s richest man, is not authorized to access this sensitive information,” James said. She also asserted that the president does not have the legal authority to grant such access or freeze payments that Congress has approved.
The lawsuit has garnered support from 17 other states, including California, Illinois, and Massachusetts. These states argue that DoGE’s access goes beyond the Treasury Department’s legal authority, violates federal law, and disrupts the separation of powers outlined in the U.S. Constitution.
Concerns Over Data Breach and Privacy
The lawsuit also accuses Treasury Secretary Bessent of changing long-standing policies that protected sensitive financial data. Critics argue that by allowing DoGE to access this information, Bessent has failed to uphold the privacy expectations of American citizens, including taxpayers, retirees, and veterans.
Connecticut’s Attorney General, William Tong, called the situation the “largest data breach in U.S. history.” He criticized DoGE, referring to its members as “renegade tech bros” who have gained access to critical payment systems and confidential records. “What could go wrong?” Tong quipped, raising alarm over the potential for abuse.
Treasury’s Defense and DoGE’s Objectives
The Treasury Department has defended its review of the payment systems, stating that its goal is simply to ensure the integrity of the system. However, sources suggest that Musk’s team initially focused on investigating payments made by the U.S. Agency for International Development (USAID). This agency, which both Trump and Musk have targeted for cuts, has added fuel to speculation about DoGE’s real intentions.
