The US government has formally stepped into a legal battle between Elon Musk’s social media platform X and the European Union, supporting the company’s attempt to overturn a €120 million ($136.51 million) fine imposed by EU regulators.

US Joins X’s Challenge Against EU Penalty

The US Department of Justice filed an application with the EU General Court on Thursday in support of X’s effort to annul the European Commission’s decision.

The move marks a significant escalation in Washington’s opposition to the European Union’s regulation of major technology companies. The EU penalty was imposed on X after regulators concluded that the platform had breached requirements under the bloc’s Digital Services Act (DSA).

The DSA requires large online platforms to take greater responsibility for illegal and harmful content, while also addressing risks associated with their services and providing greater transparency around their operations.

The penalty was the first sanction against X under the landmark legislation.

Washington Challenges EU’s Regulatory Reach

The US Justice Department argued that the European Commission had gone beyond the appropriate limits of its regulatory authority.

Assistant Attorney General Brett Shumate of the Justice Department’s civil division said the commission had “inappropriately attempted to expand its regulatory authority” to cover American companies that were not present or operating within its jurisdiction.

The intervention places the US government directly behind X’s legal challenge and adds another layer to the growing dispute between Washington and Brussels over technology regulation.

The case also comes as the administration of US President Donald Trump has increasingly criticised European technology policies.

Washington has argued that some EU regulations disproportionately affect American technology companies, while European officials have maintained that their rules are designed around consumer protection and digital standards rather than nationality.

EU Defends Digital Services Act

The European Commission has rejected accusations that its technology regulations specifically target American companies.

The bloc says its digital laws apply based on the activities and reach of companies operating in the European market, regardless of where those businesses are headquartered.

The EU has presented the Digital Services Act as part of a broader effort to make large online platforms more accountable, protect users and ensure that smaller competitors can operate on a more level playing field.

The regulation is also intended to address risks associated with illegal content, disinformation and other harmful activity on major online platforms.

X’s legal challenge therefore puts the European Commission’s regulatory approach under scrutiny, while the US intervention could make the dispute more consequential for the future relationship between American technology companies and European regulators.

Musk Has Long Opposed EU Tech Rules

The dispute is also closely linked to Musk’s longstanding criticism of European technology regulation.

Musk acquired Twitter, later renamed X, in 2022. Since then, he has repeatedly criticised EU technology rules, arguing that regulations can restrict innovation and slow technological development.

His political relationship with Trump has added another dimension to the dispute. Musk has financially supported Republican candidates and backed Trump during the US presidential election.

The Trump administration has also taken a tougher position toward European technology regulation, particularly when it involves major US-based technology companies.

X Faces Continued Scrutiny Over Content

The European case follows years of controversy surrounding changes to X under Musk’s ownership.

Rights organisations and technology experts have criticised the platform over what they describe as an increase in hate speech, misinformation and nonconsensual sexually explicit material.

X has faced pressure from regulators and civil society groups over how it moderates content and enforces its rules.

The EU’s investigation into X lasted around two years before regulators imposed the fine, making the legal challenge an important test of the bloc’s ability to enforce its digital regulations against major global platforms.

Bigger Fight Over Big Tech Regulation

The US decision to support X transforms the case from a dispute between a technology company and European regulators into a broader clash over the reach of digital regulation.

For the EU, the case concerns enforcement of rules it says are necessary to protect users and establish consistent digital standards. For the US government and X, the challenge raises questions about how far European regulators should be able to extend their authority over American companies.

The outcome could have implications beyond X, particularly as governments on both sides of the Atlantic continue to debate how technology companies should be regulated across borders.
