California Governor Gavin Newsom has filed a $787 million defamation lawsuit against Fox News, accusing the network of distorting facts about a phone call he had with former President Donald Trump. The legal action, lodged in Delaware Superior Court where Fox Corporation is headquartered, centers on Fox News host Jesse Watters’ claims that Newsom lied about the timing and nature of his conversation with Trump. The dispute arose following federal immigration enforcement operations in Los Angeles, which sparked protests and led to the deployment of National Guard troops and Marines by Trump without consulting Newsom.

Newsom’s lawsuit alleges that Fox News deliberately manipulated video footage and made false statements to portray him as dishonest, aiming to protect President Trump and discredit the governor during a politically sensitive period. The complaint argues that Fox News acted with “actual malice,” knowingly spreading misinformation to damage Newsom’s reputation and political prospects. The governor’s legal team demands not only monetary damages but also a court order preventing Fox from airing further misleading content about the incident.

Details of the Controversy Over the Trump Phone Call:

The controversy began with a late-night call on June 6 between Newsom and Trump, which took place amid escalating tensions in Los Angeles over immigration raids and protests. Newsom described the conversation as civil but noted that Trump never mentioned his plans to deploy military forces to California. Shortly after the call, Trump sent thousands of National Guard troops and 700 Marines to the state without informing Newsom, escalating political tensions.

Fox News host Jesse Watters aired segments accusing Newsom of fabricating the details of the call, including a chyron stating “Gavin Lied About Trump’s Call.” Watters questioned why Newsom would lie about the conversation, a claim that Newsom’s lawsuit says was designed to incite public outrage and undermine support for the governor. Newsom’s attorneys assert that this false narrative has harmed his political standing and diminished public trust in his leadership.

Fox News Denies Allegations and Calls Lawsuit a Publicity Stunt:

In response, Fox News dismissed the lawsuit as a “transparent publicity stunt” intended to suppress free speech critical of Newsom. The network stated it will vigorously defend itself and expects the case to be dismissed. Fox did not provide evidence that its hosts verified the claims about the call before broadcasting, raising questions about journalistic standards.

The lawsuit’s $787 million figure closely mirrors the amount Fox News paid in 2023 to settle a defamation case with Dominion Voting Systems over false claims about the 2020 presidential election. Newsom’s legal team has demanded that Fox issue a formal retraction and on-air apology from Jesse Watters, threatening to drop the lawsuit if these conditions are met.

Political and Legal Implications of the Lawsuit:

This lawsuit highlights the growing trend of political figures using legal action to challenge media outlets over perceived misinformation. Newsom, a potential 2028 presidential contender, has adopted a combative stance toward Trump and his allies, echoing the former president’s own legal battles against media companies.

If successful, Newsom’s case could set a precedent for holding news organizations accountable for spreading falsehoods that damage public officials’ reputations. However, to win, Newsom must prove that Fox acted with actual malice—knowing falsehood or reckless disregard for the truth—a high legal standard in defamation cases involving public figures.

The lawsuit also highlights the ongoing tensions between Fox News and Democratic politicians, with Newsom accusing the network of functioning as a “propaganda machine” for Trump’s agenda. As the case proceeds, it will be closely watched for its implications on media accountability, political discourse, and the boundaries of free speech in the United States.
