Hinton expressed concerns about the potential consequences of the transition. “OpenAI was founded as a safety-oriented non-profit, with commitments outlined in its charter,” Hinton stated in Encode’s release. He argued that dismantling these promises could set a harmful precedent for the industry.

Safety Concerns Highlighted

Hinton has warned about the risks associated with advanced AI. In a recent interview with the BBC, he estimated a 10–20% chance that AI could lead to human extinction within three decades. These figures are higher than his previous estimate of 10%.

Encode argues that OpenAI’s shift to a Delaware public benefit corporation undermines its earlier commitments to public safety. The brief raised questions about whether a for-profit entity could honor OpenAI’s pledge to assist other organizations nearing the development of artificial general intelligence (AGI).

Sneha Revanur, founder and president of Encode, emphasized the risks of profit-driven AI development. “A few companies are racing to deploy transformative AI, prioritizing profits while shifting risks onto humanity,” Revanur said. She called for judicial intervention to ensure AI serves the public good.

OpenAI’s Response to Criticism

OpenAI has rejected Musk’s lawsuit, arguing that he lacks standing and is using the case to benefit his AI company, xAI. OpenAI also released internal communications showing that Musk had advocated for converting the organization to a for-profit model in 2017.

Currently, OpenAI operates as a capped-profit company overseen by a non-profit board. This structure limits profit generation and investor payouts. The recent announcement to restructure as a traditional for-profit entity formalizes a change that has been anticipated for months.

The controversy surrounding this transition raises critical questions about balancing profit motives with ethical AI development. The legal battle will likely shape the future direction of AI governance.

Geoffrey Hinton, a name synonymous with artificial intelligence, has earned the title “Godfather of AI” for his groundbreaking contributions to the field. Hinton’s pioneering efforts in deep learning and neural networks have laid the foundation for today’s AI innovations. His research on backpropagation, a critical method for training neural networks, has transformed computational models. This methodology has fueled major breakthroughs in AI applications, including speech recognition, computer vision, and natural language processing.

Hinton’s achievements have been widely recognized. In 2018, he received the ACM Turing Award, often called the “Nobel Prize of Computing.” He shared this honor with colleagues Yoshua Bengio and Yann LeCun. The trio was celebrated for their work in enabling deep neural networks to tackle complex problems once thought unsolvable. This innovation has driven the global expansion of AI research and applications.
