In a dramatic escalation of the ongoing antitrust investigation into e-commerce giants Amazon and Flipkart, Samsung has leveled serious allegations against the Competition Commission of India (CCI), claiming improper conduct during a 2022 search operation.
Samsung has filed legal documents with the High Court of Punjab and Haryana stating that CCI officials crossed all limits while conducting a raid at one of Amazon’s vendors. The legal documents accessed by Reuters state that three Samsung employees were taken into custody during the search, and their mobile phones were seized and copied without any authority.
The company’s petition categorically stated that the search exercise was “patently illegal” and that material collected on the raid be returned instantly and not relied on by the investigating agency. It further sought annulment of findings regarding its conduct and was accused of contravening competition laws and collusively bargaining with Amazon and Flipkart.
Samsung in CCI Crosshairs
This case concentrates on accusations of anti-competitive conduct within the Indian e-commerce platform. A confidential report issued by the CCI notes that Samsung has committed to inducing exclusivity over launching certain handsets in Amazon and Flipkart. In a way, it goes against the provisions of free and fair competition for business purposes as decreed by the commission because “exclusivity in business is anathema and is repugnant to the doctrine of fair trade”.
Samsung, however, claims it has been cooperating with the CCI and was only acting as a third-party in the case. The company has also emerged successful in obtaining an interim injunction from the High Court, which puts all further proceedings of the case pending before the CCI in abeyance. But the court is yet to decide on Samsung’s particular requests regarding the seized data.
This legal battle is part of a bigger probe that has thrown Amazon and Flipkart into the limelight. CCI had already held the two companies guilty for violating antitrust law by reportedly favoring selected sellers on their respective websites. The trade bodies have always opposed these e-commerce sites, as they lure customers by providing them with deep discounts.
CCI vs. Samsung: A Landmark Case
The complexity of the case is further reflected in the fact that it is not just Samsung challenging the law. Twenty-two other parties have also managed to get similar injunctions from High Courts across India. In response, CCI has approached the Supreme Court seeking consolidation of all such petitions and alleging that companies are trying to obstruct the investigation.
Claims by data seizure and employee detainment have raised very high questions on the investigation processes and the limits of regulation powers.
