In one of the most egregious cases of corporate misconduct and retaliatory intimidation in modern internet history, a six-year legal battle between tech giant eBay and two independent journalists has finally come to an end. After facing years of criminal prosecutions and federal civil litigation, online auction titan eBay reaches $56 million settlement agreements alongside former top executives to resolve claims brought by Ina and David Steiner, the married co-founders and editors of the popular industry newsletter EcommerceBytes.

The historic settlement resolves a 2021 federal civil lawsuit filed in Boston following a campaign of cyberstalking, physical surveillance, and threats orchestrated by eBay’s internal safety and security department in 2019. The resolution establishes a precedent for corporate accountability, signaling that executive leadership cannot weaponize corporate security apparatuses or launch covert harassment operations against journalists and independent press outlets.

1. Inside the 2019 Terror Campaign: Live Insects, Pig Masks, and Car Tracking

The conflict originated in 2018 and escalated sharply in 2019 after former eBay Chief Executive Officer Devin Wenig and other executives grew frustrated by critical coverage published on EcommerceBytes. Rather than addressing the journalistic criticism through standard public relations channels, members of eBay’s security team concocted an escalation campaign designed to silence the publication.

What followed was a bizarre corporate terror campaign targeting the couple’s home in Natick, Massachusetts:

  • Disturbing Postal Deliveries: The Steiners received anonymous, unsolicited packages containing live spiders, cockroaches, fly larvae, a bloody Halloween pig mask, a funeral wreath, pornographic magazines, and a book titled Grief Diaries: Surviving Loss of a Spouse.
  • Digital Threats & Doxxing: Security personnel created sock-puppet social media accounts to directly threaten the couple, published their home address online, and urged Twitter users to visit their residence.
  • Physical Surveillance & Stalking: Multiple eBay security operatives traveled from California to Massachusetts, tailing David Steiner in rental vehicles, photographing the couple’s home, and planning to secretly attach a GPS tracking device to their car.

The operation collapsed after the couple noticed the surveillance vehicles and alerted local Natick police, triggering an investigation by the Federal Bureau of Investigation (FBI).

The settlement encompasses direct compensatory damages to the couple, contributions from individual former executives, and mandatory charitable donations aimed at supporting First Amendment rights and press freedoms

The civil settlement follows extensive criminal proceedings brought by the U.S. Department of Justice. In total, seven former eBay employees and contractors pleaded guilty to federal charges, including conspiracy to commit cyberstalking and conspiracy to tamper with witnesses.

Former eBay security chief James Baugh was sentenced to nearly five years (57 months) in federal prison, while former director of global resiliency David Harville received a two-year sentence. Following the resolution, eBay issued an official apology stating that the company’s past actions were “wrong, reprehensible, and should never have happened.”

In a statement following the announcement, attorney Christopher Murphy of Scalli Murphy, representing the Steiners, emphasized the broader impact of the outcome:

“This case was always about more than obtaining financial recovery. From the beginning, our clients wanted to uncover the truth, protect journalists, hold those responsible accountable, and deter future corporate misconduct.”

The news that eBay reaches $56 million settlement terms marks a pivotal moment in corporate governance and journalistic protection. The resolution serves as a clear warning to corporate boards that executing intimidation campaigns against independent reporters carries devastating financial, legal, and reputational costs.
